How is paid leave calculated in Algeria?

Under article 39 of law 90-11, every worker is entitled to 2.5 days of paid leave per month of actual work, i.e. 30 days per full year. The daily wage is calculated by dividing the monthly salary by 26 working days.

What is the seniority bonus?

Article 41 grants additional leave days based on seniority: +1 day after 20 years, +2 days after 25 years, +3 days after 30 years of service.

The National Fund for Paid Leave and Unemployment Due to Bad Weather for the Construction, Public Works and Irrigation sectors. Established by decree 97-45, it manages leave compensation payments for workers in these sectors.

What is the reference year?

It runs from July 1 to June 30 of the following year. Months of actual work are counted during this period.

Are social contributions deducted from leave compensation?

Yes, paid leave compensation is subject to CNAS contributions (9% employee share) and income tax (IRG), just like regular salary.

Does this calculation apply to all sectors?

Yes, the rule (2.5 days/month + seniority bonus) applies to all workers in Algeria under law 90-11. For construction, public works and irrigation workers, payment goes through the CACOBATPH fund.
