What are the overtime surcharge rates in Algeria?

Article 32 of law 90-11 sets a minimum of 50% of the normal hourly rate. In practice, via collective agreements: +50% for regular hours (daytime, weekdays), +100% for night hours (21:00–05:00) and work on rest days and public holidays.

What is the maximum overtime allowed?

Per Article 31 of law 90-11 and ordinance 97-03, overtime cannot exceed 20% of legal working time, i.e. 8 hours per week (40 regular + 8 overtime = 48 hours max). Daily amplitude cannot exceed 12 hours.

How is night work defined?

Night work covers 21:00 to 05:00 (Articles 26-27, law 90-11). It is prohibited for workers under 19 and subject to special conditions for female workers.

What are the worker's rights when working on rest days or holidays?

Per Article 36, the worker is entitled to: (1) compensatory rest of equal duration, and (2) pay at 100% surcharge. They receive both the rest and the extra pay.

Is overtime pay subject to tax and social contributions?

Yes, overtime pay including surcharges is fully subject to income tax (IRG) and CNAS contributions (9% employee + 26% employer).

Can overtime pay be replaced by compensatory rest?

Some collective agreements allow it: 1.5 hours of rest per overtime hour worked. The rest must be taken within 2 months and requires employer approval.
